Research results: Researchers of the Hours and Wages Division from the US Department of Labor. found that the employer paid as regular time all hours worked without paying the overtime premium for hours worked above 40 a week and did not include commissions for sales at the regular rate of payment for overtime purposes, both violations of the Fair Labor Standards Act ( FLSA ). Researchers also determined that the employer did not keep complete and correct records of the number of hours worked by employees and categorized the payment of hours worked above 40 as commissions.

Overdue wages recovered: $ 114,221 for 92 workers.                                             

Appointment: “ It is difficult to cover expenses and care for their families when workers in low-wage industries are illegally denied overtime pay ”, said District Director of the Robin Mallett Hours and Wages Division in Houston. “ Federal law requires employers to pay workers the total wages they have earned so hard, including payment of overtime worked above 40 in a week. Dr. Car Wash Plus denied workers overtime pay by categorizing payment as commission. We encourage employers to contact us with any questions related to their obligations under the ” law.
