The research team of the Hours and Wages Division from the US Department of Labor. USA has recovered $ 142,360 in overtime back wages for 65 employees of Inspire Diagnostics LLC, a COVID testing provider based in Lake Forest, California.
The division determined that the employer should have paid the affected employees the time and a half of their regular payment fee for hours worked above 40 in a work week. By not doing so, they violated the provisions of the Fair Labor Standards Act.
“ Misclassifying employees as independent contractors denies them their full wages and other employment benefits and protections. It also gives companies an unfair competitive advantage, and damages the economy ”, explained District Director for the Hours and Wages Division, Michael Speer in Oklahoma City. “ While misclassification is a common practice in the healthcare industry, companies must understand and comply with the law to ensure that workers receive appropriate wages ”.
